All they have left is to try to desperately fabricate an “unofficial act” interpretation. But, the Supreme Court won’t fall for that. They’re just allowing a cutout (official VS unofficial) for real crimes such as bribery, assault, rape, murder, fraud, etc. The 2020 election certification process were clearly official acts as President, and in my view, any attempts to criminalize it will be thrown out.
Update: Justice Thomas writes a concurring opinion in which he questions the validity of Jack Smith's appointment as special counsel. "If this unprecedented prosecution is to proceed, it must be conducted by someone authorized to do so by the American people."
